Ogdensburg man sees rape charge dismissed after DA's office unable to locate witness

OGDENSBURG  – An Ogdensburg man accused rape has had charges against him dissmissed after prosecutors say they were unable to locate the witness.

Seth A. Covelli, 30, of 308 Jersey Ave., was charged in October of 2023 with felony counts of first-degree rape and first-degree criminal sexual act following a  investigation into an alleged sexual assault.  However Cavelli saw his charges dismissed following a May 21 court appearance. He  had been jailed for more than 40 days.

St. Lawrence County District Attorney Gary Pasqua said that although the witness never changed her account of the alleged crime, the charges were dropped because they were not able to locate her, which made it impossible to secure an indictment.

In a story from WWNY Covelli was quoted as being “grateful” to his attorney Brian Barrett and for his freedom.

Covelli provided court documents to North Country This Week showing the charges have been dismissed.
