POTSDAM — The town recently approved two agreements with other governments for 2025 which will enable the town highway department to conduct its business and handle projects more effectively.
The town board at its January meeting approved a hold harmless agreement between the town of Potsdam and St. Lawrence County, as well as a intermunicipal shared services agreement with the town of Colton.
In the hold harmless agreement with the county, the town, seeking shared services from the county for projects like paving, signage, road striping, blasting, and other routine maintenance, will release the county from any liability it might incur during shared work for the year of 2025.
Specifically the resolution states “to the fullest extent permitted by law, the Town of Potsdam will indemnify and hold harmless the County, their officers, directors, partners, representatives, agents and employees from and against any and all claims, suits, liens, judgments, damages, losses and expenses, including legal fees and all court costs and liability (including statutory liability) arising in whole or in part and in any manner from injury and/or death of person or damage to or loss of any property relating to or arising out of any negligent or intentional acts and/or omissions of the Town of Potsdam or any of its directors, officers, employees, contractors, representatives, or agents.”
The resolution further extends the town's general liability insurance to cover the county during such work. The policy will cover the county for materials and products losses as well as for personal injury, fire damage and medical payments at the following levels:
The intermunicipal agreement with the town of Colton establishes a shared services arrangement between the two municipalities for two years.
The agreement allows the two municipalities to utilize “highway, non-highway, specialty equipment and /or skilled personnel (including equipment operators)” if available for authorized public works projects.
“It is expected that assistance, in whatever form, will be reciprocal and roughly equal over a period of time, and that the exchange and sharing of equipment and personnel will result in more cost effective work performance at minimal extra cost to either party,” the resolution said.
Both parties are expected to sign a memorandum in advance specifying what services, equipment or manpower will be shared and for how long.
Each municipality is still responsible for its own employees.
