Two SUNY Canton students expelled, two suspended in wake of alleged pizza assault; three accused in taxi theft face suspension

CANTON – Two SUNY Canton students accused of physically attacking a pizza delivery driver and stealing money and food from him have been expelled, while two others arrested in the same incident are on suspension pending college judicial hearings.

And three other SUNY Canton students accused of theft from a Potsdam taxi driver are facing suspension after a college hearing where they will answer college charges of disorderly conduct and theft.

College spokesman Greg Kie could not, by college rules, name the students who were expelled, or those who have been suspended or face suspension.

Three students were arrested by Canton police early Thursday, Sept. 24, shortly after the attack an assault on a Domino’s pizza delivery driver was reported at the Mountain Mart. They were Edward S. Garcia, 20, of the Bronx, Derek L. Castillo, 20, of Manhattan, and Arcenio Vazquez, 19, of the Bronx.

A fourth student, Gerome G. Phillips, 18, the Bronx, was arrested Sunday, Sept. 27.

All four face two Class C felonies each, with charges of gang assault and second-degree robbery.

The gang assault charge does not mean the men were members of a street gang. The gang assault charge means that at least one person involved in an assault intending to cause injury is aided by at least two others and they cause injury.

The delivery driver was taken to Canton-Potsdam Hospital and treated for facial lacerations, a fractured orbital bone, and severe concussion.

In addition to the assault, the four are charged with stealing $15 and food from the driver.

In the taxi driver incident Saturday, Oct. 3, Dawshaun D. Thompson, 22, Brooklyn, Miguel A. Rosario, 23, New York, and Justin L. Osuna, 21, Brooklyn, were charged by Canton police with sixth-degree conspiracy and petit larceny after they allegedly stole money from a Potsdam taxi driver after he drove them to Canton from Potsdam.

They face suspension, and “dismissal is a possibility,” for all those charges, said Kie, pending the outcome of the hearings.

“If they are to be dismissed, they have to be suspended first,” he said.
