St. Lawrence County board to hold public hearing on local law governing concealed carry permits

CANTON -- The St. Lawrence County Board of Legislators will hold a June 1 public hearing at 6:30 p.m. on a proposal to define “proper cause” for people applying for a concealed pistol permit.

The hearing will be in the legislative chambers.

In response to what they say is “mounting opposition to the SAFE Act and in an effort to safeguard the Constitutional rights of the citizens of St. Lawrence County,” St. Lawrence County Legislators Joel LaPierre (R-Fowler), Rick Perkins (D-Parishville), Kevin Acres (R-Madrid), Travis Dann (R-Gouverneur), Joe Lightfoot (R-Oswegatchie), Dave Forsythe (R-Lisbon) and Larry Denesha (R-Dekalb) have introduced the proposal seeking to resolve longstanding issues regarding the issuance of pistol licenses in St. Lawrence County.

Recent decisions issued by the United States Ninth Circuit Court of Appeals and United States Seventh Circuit Court of Appeals are at odds with decision rendered by the United States Second Circuit Court of Appeals, United States Third Circuit Court of Appeals and United States Fourth Circuit Court of Appeals in determining whether citizens applying for pistol licenses are required to demonstrate some unique need in order to receive a full carry concealed license without restrictions, according to a statement sent out by county attorney Stephen Button. New York state falls within the Second Circuit Court of Appeals jurisdiction. So far, no determination has been made as to whether the United States Supreme Court will take up the issue, the statement said.

In order to resolve the ambiguities and judicial limitations created by the term ‘proper cause’ and assist citizens of St. Lawrence County in protecting their Second Amendment Constitutional rights, proposed “Local Law ‘E’, Defining the Term ‘Proper Cause’ as Found in Penal Law § 400.00(2)(f) regarding Licenses to Carry, Possess, Repair and Dispose of Firearms” has been introduced.

Currently, applicants seeking a carry conceal pistol license must demonstrate “extraordinary personal danger documented by proof of recurrent threats to life or safety” in order to have an unrestricted license issued, the statement reads.
