RUSSELL -- A Russell man has been charged with impaired driving and reckless endangerment following a fatal accident that occurred in April.
Michael P. McCarty, 52, was charged with driving while ability impaired and reckless endangerment following a state police investigation into a UTV accident that occurred April 18 on Cole Road.
McCarty was operating a 2010 Polaris Razor when his passenger, Brian K. Barney, was thrown from the rear of the UTV while McCarty was turning the vehicle.
McCarty’s blood alcohol content was determined to be .07 percent at the time of the accident, police said.
He was also charged with speed not reasonable and prudent.
McCarty was released on tickets and is to appear in Russell Town Court.
