OSWEGATCHIE — An Ogdensburg man faces several charges including felony aggravated driving while intoxicated and failure to obey a police officer after he allegedly struck a guardrail with his vehicle Sunday.
Andy C. Simmons, 36, was charged with aggravated DWI: previous conviction in 10 years, unlawful possession of marijuana, failure to obey a police officer, driving without a license, operating a motor vehicle without an inspection certificate, failure to notify DMV of address change and improper right turn, troopers said.
Troopers were alerted by a citizen to a silver car that had struck a guardrail on State Route 37 in Oswegatchie and kept drive westbound.
Troopers caught up to the silver 2011 Ford Fusion and stopped it.
Troopers say Simmons was impaired by alcohol. He failed all roadside tests and was taken in to custody.
He provided a breath sample of .27 blood alcohol content.
Simmons was arraigned in Oswegatchie Town Court and released under the supervision of the county Probation Department.
