MASSENA -- The village board on Tuesday voted 3-0 to rescind a code change they passed at their last meeting to allow sparklers during state-approved time periods.
“At the advice of our attorney, we may have overstepped,” Deputy Mayor Matt Lebire said at the meeting.
The resolution says that Massena’s bill, which restricted the use of the legal sparking devices from July 3 to 5 and Dec. 31 and Jan. 1, was nullified by the county having previously passed the same law.
“Whereas, the Village of Massena recognizes that once a county has adopted a local law to allow such, sparkling devices are legalized in all local governments throughout that county and a city, town or village may not pass a local law prohibiting or banning sparkling devices,” the resolution says.
Mayor Tim Currier was excused from the meeting to coach basketball. Trustee Tim Ahlfeld, a New York Power Authority employee, was excused for work.
