MASSENA -- Village officials postponed taking action on a derelict property at 204 East Orvis St.
The property’s owner, Christopher Tyler, has been served a nuisance abatement notice, but has failed to act on it.
“The owner of the property was not only served papers, he defaulted, failed to respond,” Village attorney Matthew McArdle said, adding that the state Supreme Court has filed an injunction in the village’s favor. It allows them to take whatever corrective measures they deem necessary and add it to the owner’s next tax bill.
The Board of Trustees all seemed to think the property should be demolished, but want to hear more about the property and their options.
“I think we should look at what it would cost to demolish it,” Trustee Francis Carvel said. “I’m sure there’s some asbestos in it.”
“Most of the interior is pretty burnt. I don’t know how that affects asbestos,” Massena Fire Department Foreman Ken McGowan said.
He added that Tyler is in a fight over what he sees as an inadequate insurance claim and wants that resolved before he does anything.
“I think he had intentions … he’s in the middle of an insurance fight … I’m not an engineer but $35,000 is not enough to finish that up,” McGowan said.
“We already got the court approval to tear it down, let’s tear it down and put the charge on the tax bill,” Carvel said.
