Jury selection in Hillary murder trial to begin Wednesday; another ruling on DNA evidence due Thursday

CANTON -- The judge in the Oral “Nick” Hillary murder trial is expected to rule on the use of DNA evidence by Thursday.

Meanwhile, jury selection will begin among the first 100 candidates Wednesday morning.

Hillary, a former Clarkson University soccer coach, is accused of second-degree murder, charged with strangling to death 12-year-old Garrett Phillips in 2011 in Potsdam.

Judge Felix Catena, a Montgomery County justice who is overseeing the case, did not rule on a motion from the prosecution on Tuesday. Catena had ruled in August that DNA evidence would not be used in the case.

The prosecution has moved for him to go back on the order.

“He hopes to have the ruling no later than Thursday,” Court Clerk Mary Curran said Tuesday afternoon.

In addition to that, the first 100 of 500 potential jurors will be summoned to be considered for the panel of 12 jurors and four alternates.

Proceedings start at 9:30 a.m.
