Judge to issue decision in Hillary murder trial Wednesday morning at Canton courthouse

CANTON -- Judge Felix Catena will announce Oral “Nick” Hillary’s fate Wednesday at 10 a.m. in St. Lawrence County Court.

Hillary is on trial for second-degree murder, accused of strangling to death 12-year-old Garrett Phillips in Potsdam on Oct. 24, 2011.

Catena is acting as judge and jury in the matter after Hillary waived his right to a jury trial after one day of jury selection.

The trial included six days of testimony and arguments in St. Lawrence County Court, with closing statements given on the second day.

Catena, the Montgomery County judge, then said he would hold court in recess until he reached his verdict.

There is also a pending motion on which the judge has yet to rule. The defense moved after resting their case for a trial order of dismissal, citing “legally insufficient evidence” presented by the prosecution.
