Defense rests in Hillary murder trial; closing arguments begin tomorrow

CANTON – The defense in the murder trial of Oral “Nick” Hillary has rested its case.

After this morning’s alibi witnesses, including Hillary’s daughter, Shanna-Kay Hillary, the defense team called three character witnesses before bringing its presentation to a close. View that report here.

Closing statements are to begin Thursday at 10:30 a.m.

Judge Felix Catena, who is presiding over the bench trial, said today he was continuing to reserve his decision on the defense motion to dismiss the charge against Hillary, who is accused of second-degree murder in the strangulation death of 12-year-old Garrett Phillips of Potsdam almost five years ago.

The defense has claimed that the prosecution failed to present a strong enough case to merit consideration of a conviction, and has asked Catena to set the charges aside.
