LOUISVILLE -- A child was in the vehicle at the time a Louisville man, driving while intoxicated, was in an accident, state police say, resulting in a felony charge against the driver.

A property-damage accident shortly before 8 p.m. Tuesday resulted in state police charging Joseph R. Banker, 55, with first-offense DWI that was elevated to an aggravated DWI charge of allegedly also having a child in the vehicle at the time.

Troopers say their investigation continues.
