BOMBAY -- A Bombay court clerk was sentenced Wednesday for stealing more than $5,680 from Bombay Justice Court while the other court clerk – his mother – was on sick leave, according to state Comptroller Thomas P. DiNapoli.

Eric Fleury, 44, of Constable, was sentenced in Dickinson Town Court to three years’ probation and ordered to pay full restitution after his Feb. 1 guilty plea to official misconduct. The thefts were uncovered by DiNapoli’s audit and investigation of the court’s financial operations, the comptroller’s office said.

Fleury, who was supposed to collect fine money for deposit into the court bank account, instead logged the cash receipts but pocketed the cash for nearly a year, DiNapoli said.

“Mr. Fleury took advantage of another clerk’s absence to steal from the public,” DiNapoli said in a prepared statement. “I thank Franklin County District Attorney Craig P. Carriero for his persistent efforts to safeguard public funds.”
